Surf lesson liability waiver
NEPTUNE'S REALM SURF LESSON LIABILITY WAIVER
Please read carefully before signing.
This agreement is made between the undersigned ("Participant") and Neptune’s Realm Surf Lessons ("Neptune's Realm"), a surfing school located in Rincon, Puerto Rico. By signing below, the Participant acknowledges and agrees to the following terms and conditions:
1. Assumption of Risk
The Participant understands and acknowledges that surfing involves inherent risks, including but not limited to, physical injury, accidents, drowning, and damage to personal property. These risks may be caused by factors such as, but not limited to, the ocean environment, waves, weather conditions, equipment, or other individuals in the water.
By signing this waiver, the Participant voluntarily assumes all risks associated with participating in the surf lessons provided by Neptune’s Realm, and agrees to take full responsibility for their safety and well-being.
2. Waiver of Liability
In consideration of being allowed to participate in the surf lesson(s), the Participant hereby agrees to release and hold harmless Neptune’s Realm, its instructors, employees, agents, affiliates, and contractors from any and all liability, claims, demands, actions, and causes of action for injuries, damages, or losses sustained as a result of participating in surfing lessons, whether caused by negligence or otherwise.
This waiver applies to any injuries or damages sustained while participating in surf lessons or related activities, both on land and in the water, and extends to all claims, whether or not caused by the negligence of Neptune’s Realm.
3. Indemnification
The Participant agrees to indemnify and hold harmless Neptune’s Realm, its instructors, employees, agents, affiliates, and contractors from any and all claims, demands, actions, suits, losses, damages, or expenses arising out of or related to the Participant's involvement in the surf lessons, including but not limited to legal fees, costs, and other expenses incurred as a result of any claims made against Neptune’s Realm.
4. Health & Fitness
By signing this waiver, the Participant certifies that they are in good physical condition and capable of participating in surf lessons. The Participant agrees to inform the instructor of any medical conditions, injuries, or limitations that could affect their ability to safely participate in surfing activities. If the Participant is under 18, a parent or legal guardian must sign on their behalf.
5. Photography & Media Release
The Participant acknowledges that Neptune’s Realm may take photos or videos during surf lessons for promotional and marketing purposes. By signing this waiver, the Participant grants Neptune’s Realm permission to use such media, without compensation, for promotional or educational purposes.
6. Compliance with Instructions
The Participant agrees to follow all safety guidelines and instructions provided by the surf instructor during the lesson. Failure to comply with these instructions may result in the Participant being asked to leave the lesson without a refund.
7. Governing Law
This waiver and release shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico. Any disputes arising from this agreement shall be resolved in the courts located in Rincon, Puerto Rico.
8. Acknowledgment of Understanding
The Participant has read and fully understands this waiver, and by signing below, acknowledges the risks associated with surfing. The Participant voluntarily agrees to the terms and conditions outlined above.
